Freight Transportation Services / Claims

I have a claim against a Freight company that insists I pay the freight bill that coincides with the shipment when the goods were damaged. They will not continue to process the claim until the payment is made and tell me that federal law dictates that I must pay the bill even if they agree to pay the claim.

I did not include the feight bill in the claim as I did not expect to have to pay it.

Cargo damage is one of my specialties. Whether you have to pay even if the cargo is damaged will depend on the terms and conditions of carriage. They may very well be right. You should make sure you immediately note the damage and make claim on the carrier, and notify your cargo underwriter, if you have one.
