Legal Question in Credit and Debt Law in California

A Friend Gave Me A $10,000.00 Bad Check

A friend gave me a check for $10,000.00 for a loan where we executed a note, everything legal. I found out today that the check is no good. My bank had already credit a partial amount of it to my account so I had written some checks for bills that will probably bounce now. My friend expects me to just give him back his check and say neer mind - do I have any legal recourse?

Do -not- give back the check. It might be used as evidence if you have to file a lawsuit or go to the district attorney.

However, give your friend the opportunity to make good on the check and your own bounced check fees, by paying you a cashier's check within XX number of days. If not, you might either take it in payments, or file a lawsuit.
