Legal Question in Credit and Debt Law in California
My friends husband passed away and he had a credit card in his name only. The company has told her they will settle with her at a lower amount. They owned a home and several cars. Does she have to pay the credit card company?

The debts could easily be determined to community prooperty debts and the surviving wife could easily be held responsible.

If the balance on the cards was created during the marriage, it would be community debt, and all community property would be available for the creditor to collect from.
