Legal Question in Credit and Debt Law in California
Harassment by collection agency
I owed Washington Mutual 9,000 dollars that I couldn't make the payments on due to job loss. It went to a collection agency name Stoneleigh Recovery and Associates. They called a neighbor yesterday and sent him over to my house with a note to call them. I wasn't answering to Stoneleigh because they were demanding and I couldn't deal with them. First, was that legal to call the neighbor that we don't know since who they are came up in caller ID. Second-after I called back and told them I couldn't come up with the 1,000 dollar payment they wanted by Nov. 4th the conversation went on and this Jason Jeeter told me to gather up all the money we had to hire an attorney because they were going to sue us. I am willing to make smaller payments that other creditors have done-but I can't do this payment. Can they actually sue us? They are a collection agency not a law firm. Also I tried to make payment options with Washing Mutual but they said it was too late that the collection agency had bought it.

Re: Harassment by collection agency
Can they actually sue you? Yes. What can you do about it? You can defend the lawsuit or file bankrutpcy. If you should decide to defend the lawsuit, you may want to add a cross-complaint for violation of the Fair Debt Collection Practices Act. That may get them to back off a bit. Once you hire an attoney to represent you, they can no longer legally contact you.
