Legal Question in Credit and Debt Law in California
Harassment from Collection Agency
About a year ago someone has gotten hold of my bank account number and my personal information. My information was then used to set up an account with Western Union to send cash to someone. I disputed the charge with my bank, they investigated my claim and money was credited back to my account but now WU is having a collection agency to come after me for the money my bank took back from them. WU claimed someone in my household set this account up since that person has my personal information therefore I am liable. The collection agency pressured my 13 year-old daughter on the phone to give him my cell #, my boyfriend's cell and work # under a false pretense that it's an emergency. He's leaving messages at my boyfriend's business cell & work phone, our home phone and my cell. He calls at 6am, sometimes every 5 minutes for a period of 30 minutes daily.
Question: what's my right as a consumer? Do I owe this money to WU even though my bank told me I am not? What actions can I take against this collection agency?

These people are violating the law. A strong letter from an attorney may stop the harrasment and may even help in ridding yourself of the debt.

Whether the debt is valid or not, the collector and the agency are violating collection laws.
You can sue them for damages.
