harrased by collection agency over clerical error

Due to a clerical error my name was sent

to collection agency by earthlink. despite

months of efforts on my part and promises

on earthlink's part this has not been

resolved. i am recieving daily calls from

collection even though i have written proof

from earthlink that i do not owe them any

money. what are my rights, recourse?

restraining order? lawsuit?

A legal cease and desist letter should be promptly sent to put the collection agency on proper notice.
