Am I being harrassed?

The California Statute of Limitations (4 yrs.) has passed on the agreement I signed to a local hospital for emergency room services. The collection agency who purchased the account continues to call daily and harass me even after I asked them to stop. What can I do?

Whether the statute of limitations has runs depends on a number of factors. For instance, if you agreed to make payments, and have defaulted on those payments, the statute does not begin to run until the first payment was missed. You should probably review the Agreement and your records to make sure the statute has actually run.

With respect to the bill collector's calls, you should go to the Federal Trade Commission's (FTC) website at www.ftc.gov; they have a wealth of information on the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and you may also register a complaint against the bill collector. You might also want to remind the people calling you that they may be in violation of the Fair Debt Collection Practices Act, and that you will report any violations to the FTC.
