Legal Question in Credit and Debt Law in California
Harrassment by a lawyer deceiptfully trying to collect a debt
I am being harrassed by a collection law firm who are using unethical tactics to try and collect a debt. I sent them a ''Cease & Desist'' letter by Certified mail, the card came back yesterday UNSIGNED by the law firm addressed to. No letter was attached, but I was wondering what my Legal Rights are in light of the above? They have threatened that they can go to court and get a judgement against me and then garnish my wages withouy taking me to court, is this true? Also they wanted me to borrow the money from relatives to pay back the debt. My husbang is on Social Security and I have Multiple Sclerosis and this is all adding up to great emotional hardship. This law firm are on the web, and have been sued for acting ''Unethical''.
Any help with the above is greatly appreciated in advance

I don't usually give this advice on here, but here is my advice: find an attorney who handles these cases near you and talk to him or her about this. I don't know where you are, but you can go to www.naca.net and find a consumer attorney to assist.

I am sorry to hear the about collection firms actions and the impact it has had on you.
I have experience protecting consumers from abusive debt collectors and asserting their rights under federal and state fair debt collection practice statutes.
I would be willing to discuss some of the issues concerning your experience to see if there may be legal justification to pursue your case.
I offer prospective clients an initial consultation of 30 minutes for free.
I look forward to speaking with you.
Yours truly,

You may have a claim against the law firm under the Fair Debt Collection Act. We would have to review any letters you received. Please call us if you have any questions.
