Legal Question in Credit and Debt Law in California

Hassled by collection department

I want to know what the law is concerning harrasment from a company for a debt not owed. I have a mortgage company that did not record a payment that I sent to them for my note. I have a copy of the checked cashed by the company, but they never posted the check to my account. I have faxed them copies of the check on more than four occassions and still they have not rectified the problem. In the meantime I receive a telephone call from their collections department at least 2 to 3 times a week, as well as letters demanding payment. When I call to discuss the problem, I speak with a representative and I'm told the same thing to fax the copy to the research department, which I do to no avail. This is being to stress me out. What can I do???

Demand to speak to a supervisor. Tell them exactly what happened, then get their name, mailing address and direct phone number. Mail all documentation by certified mail, return receipt requested, and include a letter indicating that you will contact the appropriate government consumer affairs agencies. Then follow up.
