Can a Health Club Charge More than the CA Civil Code States?

I have moved 200 miles away from a health club in which I have a one year term contract. I have paid seven months of the contract so far. The Health Club says I can cancel the contract for a $150.00 fee. In a search to answer my own questions about the matter I read the California Civil Code 1812.89(b). It states ...''that if the person agreeing

to receive health studio services moves further than 25 miles from the health studio and is unable to transfer the contract to a comparable facility, such person may be charged a predetermined fee not exceeding one hundred dollars ($100), or, if more than half the life of the contract has expired, such person may be charged a predetermined fee not exceeding fifty dollars ($50).

Can the health club legally charge me more than the $50 stated in the Civil code?
