Legal Question in Credit and Debt Law in California

Hi,

I received a letter from Diversified Collection Service Inc trying to collect a debt from National Collegiate Trust fro $44,000

the letter has my name on it but I have never aplied for a Student Loan in fact I have never been in colleage. I called DCS and they told me if I don't pay teh would send me to collect.

What can I do or when can i go to have this solve, it sounds Scam for me anybody can help?

There is a decent likelihood that this is a scam. Have you searched online for those two entities, and any complaints or reports of them attempting to collect debts that don't exist? First thing you need to do is send them a debt validation request in writing. You need to write to them disputing the debt, and insisting that they provide you documentation to verify that you actually owe this obligation. I would also pull a copy of your credit report from the three reporting bureaus. If it does not appear on your credit reports, then it is probably just a scam, and you should report it to the Federal Trade Commission, Better Business Bureau, and if they continue to pursue you, you may even want to file a police report (identity theft). If, however, it is on your credit report and/or they provide verification of the debt, you will need to contact an attorney about the possibility that your identity has been stolen.
