If you are a lienholder, you do not own the car. California law allows the tow yard to keep the car until someone pays the storage and towing fees. If your lien is of record with DMV, the tow yard should notify you and give you the opportunity to pay the fees and recover the car. You do, however, need to ensure that you comply with California law regarding repossession of a vehicle. If the vehicle is sold at auction by the towing company, then your lien is extinguished and you will no longer have any interest in the vehicle.
