Legal Question in Credit and Debt Law in California

Identity Fraud

A major department store has issued instant credit to an identity thief using my name and social security number. The thief is never asked for any other identification.

The resulting debt is a big headache for me e.g., numerous phone calls, credit problems, etc.

If the department store had been more careful about to whom they gave credit, I wouldn't have these problems.

Is the department store liable for any of my time and hassle?

Re: Identity Fraud

The short answer is no. It is unfortunate, but there is no civil remedy for what you seek. However, you may get some satisfaction by complaining to the highest levels of the company, lodge a complaint with the better busuness bureau and maybe even contacting the consumer affairs reporters for the local television and newspaper outlets.

Good luck-Martin
