Legal Question in Credit and Debt Law in California
Identity fraud
My wages are being garnished. In 1997 I lost my walet. Apparently someone was able to rent an apartment using my Drivers license. Now they are taking $1100.00 out of my paychecks. This is the first I have heard anything about this matter and they have already taken $209 out of my check. This happened in 1997.I have never rented an appartment in my life. Is there anything I can do about this?

Re: Identity fraud
You should be able to correct this. Send the Creditor's attorney all proof that you never lived there and other documentation. If you fax me all documentation that you have including the court documentation to 714 363 0229, I will provide you with further consultation if this does not work or if the creditor's attonrey does not respond to you. He should respond immediately since there is a wage garnishment in effect.
Re: Identity fraud
Yes. Go to the court where the garnishment was issued-you can find out from your employer-and claim it is invalid for lack of notice and go and fight the matter. You should be able to contest it yourself but you may need to employ the services of a lawyer.

Re: Identity fraud
If a lawsuit was filed against you without your knowledge and you were never served (meaning you were never given a copy of the complaint so you had a chance to respond), you can get the judgment set aside. When the judgment is set aside, the garnishment would be stopped.
