Inaccurate info on my credit report
Would it be worth my time, effort, or money?
I had a VA mortgage with ABN AMRO. The loan was refinanced to another institution in OCT 2002. During a refinance in Feb 05 I found that ABN AMRO was incorrectly reporting the account as foreclosed. I disputed this and received a letter from ABN AMRO in FEB 05 stating that they were correcting the problem. On 11 May 06 I received a letter from ABN AMRO stating that a foreclosure was completed in July 05, and that the account was not paid in full. I have just received verbal word from ABN AMRO, after many phone calls, that they made a mistake and are removing the foreclosure from my credit report.
I have filed complaints with the FTC and BBB. I believe I have been denied credit, as well as being forced to pay excessive interest charges and points on loans because of this foreclosure that was supposed to be removed.
Am I entitled to compensation from ABN AMRO? Is it worth my time, effort, and expenses to pursue a settlement?

You may be entitled to damages from the mortgage company based upon their incorrect reporting of your credit. The amount you may be entitled to may include the excessive amounts you have paid in interest and points because of the incorrect report, as well as statutory damages.
You should consult with a consumer attorney in your area and provide that attorney with all documents you have showing that you were denied credit, together with the amount of excessive interest and points you have had to pay.

It is possible that you have a case. The biggest issue will be proving that you have been denied credit or that you were issued credit on unfavorable terms because of the false foreclosure report. Do you have facts to that effect?
