insurance claim/debt

I owe to progressive insurance for an accident. I need to know what my rights are to pay it back. Because I can not afford what they are asking for and they want to have my lisence suspended.

Based on your description, it sounds like you caused a car accident and had no insurance. Now the other driver's insurance paid benefits to its policy holder and is seeking reimbursement. This is called subrogation.

If you do not reach a settlement, the carrier would need to file a lawsuit against you and get a judgment before suspenion of your license could take place. If the judgment remains unpaid for 30 days, the carrier can report the judgment to the DMV for license suspension.

If owe the money and want to avoid a lawsuit, your best bet is to make a counteroffer to the carrier. You should contact a local attorney to assist you with settlement negotiations. Or you might also consider consulting a bankruptcy attorney if you cannot pay.

Mr. Starrett gives you good information. You need to remember that the insurance company will be very agressive with you. You need to talk to an attorney so you know your rights, including things like comparative negligence, etc...
