Legal Question in Credit and Debt Law in California

Joint Credit - second payee not responding to dues

What should happen if a couple had a joint credit account prior to marriage, and upon break up (also pre-marriage), fiancee still owes large sum ($8,000 remains) to credit card which is now only in the other party's name? He is not responding to the credit bills and will not return calls to other party. Party who is stuck with bill is now living in Washington State, and party who owes money is living in California - the two lived in California when they were together. Party in Washington is being called to pay bills that are not hers.

Re: Joint Credit - second payee not responding to dues

Well without more details I can generally tell you that if you were joint on the account and the card you are both liable for the bills. However, you may be able to recover from him any monies paid by you for expenses incurred by him. There are two contracts at issue here with him and with the card company. Feel free to contact my office with more details for a more comprehensive answer.
