Judgement

my brother bought a motorcycle using my credit, he never paid it. now the finance co. is after me aggressively, they are saying that they dont want to receive payments anymore they want all their money complete. i have offered to make payments but they dont want to. they are threating to file a judgement against me. how long does that process take? and what does that ''judgement'' include?

Let me answer your question about what the judgment includes first. The judgment includes the amount owed on the motorcycle after sale at an auction, the auctioneer fees, the repossession company's fees, interest accrued on the amount owed, late fees, attorney fees, costs of suit, storage fees, and anything else the plaintiff can convince the court it is out of pocket. Usually, these type of judgments exceed $10,000.

Now on to the other question as to how long it takes. Plaintiff can enter a default against you on the 31st day after you are served a summons, and will usually obtain a judgment soon thereafter. Within a few weeks thereafter, the plainitff can empty out you or your wife's bank accounts, attach you wages, put a lien on your home, commence a foreclosure process, and attach or seize any other non-exempt assets you may have.
