Legal Question in Credit and Debt Law in California

Judgment Entered Without Knowledge

I recently received info from a retail credit association that there was a judgment obtained against me on 4-02-91. The amoount due is accruing interest at 10% per annum. They have also recorded an Abstract of Judgment and the total amount that they say I owe is $4474.35!!! Is it possible to obtain a judgment without the knowledge of the "so-called" debtor? If so, how? I was never served with papers or notified at all until now that this judgment existed! What can I do? PLEASE! I need help! Thank you... very much for any information!

Re: Judgment Entered

No, they cannot get a judgment without notice to you. What may have happened is they filed a false declaration saying they served papers on you when they really did not. This is a common practice among collection attorneys. You need to first examine the court file to see what was filed and get an attorney to file a motion to vacate the judgment based on failure to serve you notice of the lawsuit.
