Judgment From Missour1e

My ex-husband lives in El Dorado County in CA. I live in Ohio. I have a judgment against him from the state of Missouri where we were divorced in the amount of about $11,000. We went to trial there. I have tried several things but I can not get anyone to enforce this. What do I need to do? I don't have much money but I worked for an airline so I can fly there if need be. As long as your judgment from Missouri is still valid, you should have no problem finding an attorney to handle this. Collection work like this is done on a contingency, meaning the attorney collects a percentage of the recovery (as his fee).

The process is as follows. You obtain a certified copy of the judgment from Missouri and send it to the attorney in California who will enforce it here. The judgment gets "domesticated" here - which means a new lawsuit is filed, but the difference is that there is no legitimate defense to the judgment. In short, absent extraordinary circumstances, you will typically have an enforceable judgment in California within 30-45 days. At that point, we can begin all the usual enforcement measures, such as garnishing wages and seizing assets.

As the other attorneys have stated, the process is not too difficult. You may want to get a lawyer from El Dorado county, however, since everything will be handled out of that court.
