Legal Question in Credit and Debt Law in California

Old judgment over 16 years

I had a collection that went into judgement over 16 years ago, for my mother's funerla arragements.

In 1992-93 I tried to filed Bk but since at that time I owed a store a couldn't do it.

They collection agency re-filed the judgment but I was never served because I didn't lived at the address they claimed they served meand my relatives had sold the house years before that date.

Last week they started calling me to my work and I just noticed they run my credit. Do I have any recourse to fight this judgment? I tried many years ago to settle for 50 %but they got really nasty and I told them to stop bothering me.

Would like to pay them but the interest and charges had escalated to over 10.000

thanks

Probably the only thing you can do now is file bankruptcy. Even if you do not qualify for a chapter 7 under the new laws, you can file a 13 and enter into a repayment plan in which you may only have to pay back a portion of the debt.
