Legal Question in Credit and Debt Law in California

A law office hired by Citibank to collect on an unpaid account will bring the matter to court unless it is paid to their satisfaction. the debtor in this case has mental disability receiving SSI, unable to find a job for at least four years now, apparently due to his condition. He now is asking help from his parents to settle the account fearing he might be jailed causing him to quit schooling and trying to find a job. His parent and relatives can probably chip in to raise the repayment money at a reduced amount , if that is what it takes to keep his "sanity". The law office is vehement in refusing payment for less than what they are willing to accept. They are not willing to extend the deadline for settlement beyond 30 days plus one day. They were already about the debtor's illness. Can you help us?

Is the law firm aware of these facts? If so, their collections tactics may be considered abusive under California's Rosenthal Fair Debt Collection Practices Act. Instead of paying the debt, it may be possible to higher an attorney who specializes in that type of case to file a lawsuit against Citibank and their attorneys.

Bankruptcy is another option to consider. You might be able to find an attorney to take the case at a discount because of the mental disability.
