Legal Question in Credit and Debt Law in California

Levy of Account

I have writ of execution. Levied the debtors account. Can I continue to levy the account off of the one writ or do I have to apply for one each time?

Re: Levy of Account

The Writ of Execution is good for up to 180 days from the date of issuance. The Sheriff's Department will keep the original writ until it expires and then it will be returned to the court.

So long as the Writ is valid, you can have the Sheriff perform multiple levies and not just bank account levies. You should keep a photocopy of the Writ for future use. For each new levy, provide the Sheriff with enough copies of the Writ to serve the necesary parties, new levy instructions signed by you or your attorney and the appropriate levy fee.

It is often difficult to levy a bank account more than once because a judgment debtor would normally close the account. Contact my office if you need further assistance.
