Legal Question in Credit and Debt Law in California
Lien on my home?
Two years ago I purchaced my home. Last year I refinanced. The today I went to refinance again. Major problem. There is a lein on my home. I was shocked. The finance company said it was strange because there was no doller amount. I went to the county clerks office. Indeed there is a lien. They also had no doller amount. They showed it was from a unpaid doctor bill back in 1993. First of all, do they not have to contact me before the put a lien on my home? Second can a lien still be put on my home after 9 years? How do I get rid of this lien? Apparently it was a county run doctor office.

Re: Lien on my home?
I am afraid that all you describe is possible. It will require you to bring an action to have the lien expunged, or vacated. I would suggest that you contact the administrator of the doctor's office and see if you can't reach some agreeable resolution before retaining counsel and taking legal steps to get relief.

Without a lawsuit, you may have a case against the doctor for slander of title. Please fax all documentation you have including a copy of the lien and I will provide you with free consultation to 714 363 0229.
