Legal Question in Credit and Debt Law in California
lien paid by non-guilty party
if a lawyer files a lien and a non-guilty party with the same name as the guilty party mistakenly pays the lien through a home refinance because the lawyer did not include any ssn# or cdl# ''only a name'' on the lien he filed with the hall of recoreds, is he legaly obligated to return the money? note: he gave us a letter a year earlier stating we are not the guilty party but took our money a year later when we refied again and when i called him to demaned the money back he lied and said he didnt have it and gave it to his client anyway. is what he did angaist the law?

Sue the lawyer for "conversion" (theft). I bet when you do, the lawyer gets thrown in jail and/or disbarred. I also would be surprised if the client saw any of the money.
