Legal Question in Credit and Debt Law in California
I used to live in Canada untill a couple of years ago. I moved to California in late 2007. I recently got a call from a colections agency in Canada about an outstanding debt that is currently under C$500 that is owed to Capital One Canada. I wanted to know if the Canadian collection agency could take actions against me here in the US?
The collector who called me threatened to contact Capital One USA to have them attempt to collect the outstanding balance, is this possible?
Also, they threatened that they would report this to the US credit rating agencies, but I thought that US and Canadian credit rating agencies were distinct from the other; am I wrong in such an accessment?

Yes they can sue you here, because this is where you now reside and that gives them jurisdiction over you. However give them a call and suggest to them it won�t be worth their bother suing you here and see what kind of deal you can make with them. At the end of the day all they want is money as quickly as they can get it. Try offering them 25 cents on the dollar, Canadian that is and see what they say. Remember the quicker the payment the more they are going to discount your debt.
