Legal Question in Credit and Debt Law in California

loan for a school I did not attend

I took out a loan to attend an IT technical school. I was unable to attend due to military obligations. My lender contacted me to start repaying the loan. When I contacted the school to get them to return the loan check to my lender. They said they were not in a position to return the money at this time due to financial problems. What are my options in this case.

1. Start paying off the loan.

2. Consider suing the school, if they can still be found.
