Who Should We Make Claim Against?

My daughter's car was in an accident. The other party was at fault. Their insurance company paid for some body damage. Now the insurance co. refuses to pay for mechanical damage and won't pay for the determination of the cause of mechanical damage nor the rent car. I am paying for all of the above plus repairing the damage. Should I make claim or my daughter? Should I or she make claim against the other party or their insurance company? It will total under $5000 and I believe we will use the Small Claims Court. bye

The registered owner of your daughter's car should file the claim against both the other driver and the registered owner of the other vehicle.
