Legal Question in Credit and Debt Law in California

Michael Stone thank you for your answer this loan is at least 10 years old they have purchased it from the original co. They only have had this since Oct of last year. At first I became frightened and said but not in writing they could take out 2900.00 all at once but now I can't afford it and would like to send them payments. Nothing in writing as of yet. They did send me a statement for me to sign regarding the $2900.00. They seam to have lots of information, like my house payment and car payment. I want to send a check as a payment can I do this without them taking me to court.?
