Legal Question in Credit and Debt Law in California
i am a minor an i need help
Hi I am 16 years old, a while ago I applied for a work permit program through my high school. They helped me set up an interview and luckily I got a job at a store. This is my first job and when I received my first paycheck I immediately cashed it. I quit my job to finish up high school and now I have received a letter telling me that they made a mistake and that they paid me more than I had earned and that I need to pay them back. If not they will send me to a collection agency. I do not have any money that is why I applied for the program and now what do I do. Is what they are doing legal?

If you were overpaid - you need to review the paycheck and compare the hours to what you actually worked - then yes, they can recover from you the overpayment. I would suggest that you discuss with them some sort of resolution before it goes to collection - work out a repayment plan or something. If you are sixteen, where are your parents in all of this? It would be best if you simply repaid what they are entitled to, and put it behind you. Ask your parents for assistance with resolving this.
