Legal Question in Credit and Debt Law in California

Misleading information on loans

Hello, I am a student that comes from a very poor backround. When I started school I wanted everything to be in my name, but the financial aide office told me to put it under my mothers name. I didn;t think she would get approved because she doesn;t even have a bank account, is Deaf and lives in a trailor park and owns NOTHING. At first I thought i would pay them back, I even asked if I could start paying it back after I graduated...and they said it would be no problem. Well a couple months after school started my mother started getting this bills, and she seemed to have no idea what they were, she signed them but niether of us realized I couldn't pay this off. I have applied for deferment but that is only going to work for so long and interest is getting higher and higher. My mother only gets social security and that is all she will ever get...will they take it away from her? I really feel like I was mislead. I have already tried to put it under my name. What can I do? Thank you for your time

Re: Misleading information on loans

If it was a student loan, it should be in deferment until about 6 months after your scheduled graduation date. I'm not sure I understand why they're trying to collect yet.

Re: Misleading information on loans

Your facts are somewhat unclear. If the loan is in deferred status, why are they collecting?

At any rate, social security disbursements are generally exempt from execution.

Seek out the advice of a competent collection attorney for advice specific to your particular facts.

Good luck.
