Monies owed our company

We provided a service and we are still owed $194,000. Is there a time limitation to file a law suit?

There are a variety of statutes of limitation for collection of debts. It depends upon the type of service you provided, whether you had an oral or written agreement and a host of other issues. If you post more details, I'm sure members of this site can get you an estimate, but to really be sure, and with a debt of that size, I would strongly suggest spending the time and money to have an attorney review it and suggest your course of action.

If you had a written contract, an attorney would need to review it to determine for certain the timeframe you are looking at.

However, and in general, if you do have a written contract, you four (4) years from the date of the breach of the contract in which to file a lawsuit.

If the contract was verbal, you have only two (2) years.

Either I or another qualified business attorney could review your contract. If you would like me to, I charge $200 for the review and an opinion letter as to your issue. Please feel free to email me a copy of the contract if one exists, as well as the date of the breach.

Generally the statute of limitations for a written contract is four years and two years for an oral contract. Please call us if you have any other questions.
