Legal Question in Credit and Debt Law in California
My Mother Used My Name
I am 21, and i just found out that my Mother used my name Driverlicense number and SS# to open up her water gas and electric. My mother does not pay bills she is a deadbeat. But now that im no longer living with her and trying to get my own place i am unable to open up these accounts. I have great credit for a 21 year old i always pay my bills. But the electric balance is $900 and this is going to ruin me.
How can i fix this and prove that it wasent me who opened these acounts and what action can i take against my mother.
at least one of these accounts were opened before i turned 18.
Thank you

Re: My Mother Used My Name
According to Civil Code Section 1788.18 a debt collector must cease all collection efforts once the proper notices under that section are given, including a police report showing you have reported your mom for criminal activity. In the event you are not willing to prosecute your mom, you will have to look to other alternatives, i.e. pay the debt and then sue your mom in small claims court.
