Legal Question in Credit and Debt Law in California

Nat'l.Arbitration Forum Award

A firm in Atlanta filed with N.A.F. and received an award for their claim. I protested mandatory arbitration. My question is: With this award can my checking account be seized, or is there a California court order required?

How am I notified if I'm subject to having my money captured?

Re: Nat'l.Arbitration Forum Award

The winner of the arbitration award will first need to convince the court that the arbitration award is valid and have it entered as a judgment. They will need to notify of any such proceedings. You should retain legal counsel now to advise you on the validity of the arbitration award and to determine what legal remedies you have.

Re: Nat'l.Arbitration Forum Award

They could try to turn the arbitration award in to a judgment. If they succeed, they can garnish your wages or attach your bank account. When you first received notice of the arbitration, you should have fought it. Now, you MUST retain an attorney and fight this. Do not wait any longer.

Re: Nat'l.Arbitration Forum Award

You have 100 days to file a motion to attempt to have the award overturned. Expect them to file for a court judgment on day 101.
