Legal Question in Credit and Debt Law in California

Old Navy charging me $250.00 for stealing $48.00 worth of their product.

In November my friend stole a pair of pants worth $48.00 from Old Navy and security caught them outside the store and they returned the pants. Old Navy then took them into a room to interigate them with no lawyer and no parent or guardian present. This person was 16 at the time of the theft. Now they are asking for $250.00 and if they don't pay by May 2, 2002 they will be taken to court and charged $1,200. Old Navy is using the Civil Recovery Services to get the money. Is this legal and if so what can I do to fight it?

Must be California procedure, no it is not legal to threaten criminal prosecution to get paid in a civil matter. your Friend needs a lawyer, in that district.
