non-contract agreement & credit bureau collection w/interest
My former employer has given my name to the credit bureau w/interest and I never signed any agreement or contract for the money demanded, that I did not receive. What are my rights and what does the law saw about my credit being damaged and harassment from the credit company and former employer? Please advise. I have been advised that they are going to file a civil judgment against me if I don't pay.

if there was never a written contract or enforceable oral agreement regarding the monies at issue here, then you are not liable for this debt period, especially if you never received the consideration (money) that is the subject matter of the agreement. thus, you would prevail in a breach of contract suit against you based on the facts given so far. finally, if negative information has been entered on your credit reports, you are within your rights to demand a verification/validation of the alleged debt owed under consumer protection laws. you should immediately and legally challenge your employer here as well as the negative reports.

Since you did not borrow or receive any money, you may have a claim under the Federal and State Fair Credit Reporting Act, Invasion of privacy, and possibly fraud. Please contact us if you need further assistance in persuing your claim.
