Non-payment of commissions due

My former employer owes me $39,000 in commission wages. While they do not dispute my claim & have agreed in writing to pay me based on a payment schedule they have defaulted & stopped payments. They have ceased all operations, but not filed bankruptcy claiming they have signed a judgment with the bank and therefore no longer have control over their financial assets. The bank does not respond. The CA Labor Commissioner says there is nothing they can do to force payment. Their are significant assets (building, inventory, etc.)remaining which should easily cover this relatively small amount if I can somehow attach this debt to them. What legal recourse do I have to collect this money?
