notice of levy under writ of execution

I am a small business. I was served with a notice of levy under writ of execution. This financial company got a judgment against the husband of my employee and is trying to collect her wages as community property. How do I fight this?

While your intentions are admirable, this is not your fight. It is up to your employee and her husband to file the necessary paper with the court the levying officer to fight levy. The levy has the same impact as a court order and you or your company could be liable if you do not comply.

Your employee should see her own attorney about how to respond. The sheriff probably served her with documents on how to claim the levy proceeds or wage garnishment as exempt. She needs to read those papers and take action on her own.
