Legal Question in Credit and Debt Law in California

overpayment of alimony

ex-wife remarried and still collected alimoney for 11 mo. withough telling me. Heard it from a friend. Have to go to Long Beach to file in small claims court. Is there a time limit that I have too file the claim from the time I found out she was illegally accepting alimony? Can I do anything over the phone or internet.

Re: overpayment of alimony

I don't believe that you can take this overpayment issue to Small Claims Court. The court which handled the original order for the payment of alimony still has jurisdiction over all aspects of that procedure, including overpayment or fraud. File a motion in that court.
