Legal Question in Credit and Debt Law in California

I owe 22k on a loan that I defaulted on. It was charged off Jan 22, 2013. I am unable to work and living off 950/mo alimony. Had to move in with my Mom, which is temporary. It Has allowed me to keep up on my other minimum payments to credit cards. I currently have over 50k in unsecured debt. Because I was a stay at home mom I don't qualify for SS Disability. Even SSI is not an option due to Alimony being considered unearned income. I could be sleeping in my truck soon, but Bankruptcy would take that away from me. It's worth 10K. Community resources are very limited(homeless shelters, etc) for someone of my age(I will be 50 soon). I am worried the collections agency will take me to court. Should I let them know my temporary address in AZ should they file against me? I am maintaining a P.O. Box in CA. I am not even sure I could get enough money together to show up in court. What are my options?

Bankruptcy is certainly an option. If you were in California, there are plenty of exemptions available to allow you to keep your truck. Do you reside in California or Arizona and have you resided in that location for more than 180 days? If you are in California, please call me to discuss. Otherwise, if in Arizona, I would be happy to provide a referral to a good bankruptcy attorney who can help you out.

My telephone number is (925) 362-1725.

I agree that bankruptcy may well be your best solution. You should meet with bankruptcy counsel at your earliest opportunity for guidance. At a minimum, you should do some reading about bankruptcy to learn more about what it might mean in your case.

Best of luck to you.
