Legal Question in Credit and Debt Law in California
Pages accidentally ommited upon filing demurrer and motion to strike
I just filed a demurrer and motion to strike to Plaintiff's Amended Complaint, yet, of all days to have printer troubles, I am concerned I may have left out a few pages of the memorandum of points and authorities that should have been included. Though the demurrer was signed, the Memorandum signature page, if included also may not have been signed. Oh boy.
Is there a simple fix to this conundrum?
May I simply go and re-file the exact complete signed document tomorrow or must I somehow make a motion or something such as to amend? May I go to the Clerk to add these missing pages.
Plaintiff has be mailed full copies with appropriate proof of mailing.
Intent was appropriate, ,though some pages and signature may not have been included.
Help please.
Thank you.

Call the courtroom clerk and ask what to do. You obviously should have the entire demurrer on file.

You should re-file. No motion would be necessary.
