Legal Question in Credit and Debt Law in California

Un paid debts

My brother has about 6 unpaid credit card debts that have turned into charge-off's on his credit reports. They total about $14,000. He now is getting back to where he might be able to start paying the accounts which turned into collections. Should he contact these collection agencys and make arrangements or does it really matter since they are at least 5 years old and are into collections?

Re: Un paid debts

The statute of limitation in California for enforcing a written agreement is 4 years from either the last payment or failure to pay, whichever is later. Therefore, it's highly unlikely -- given the facts that you present -- that any of the debts are collectible.

Re: Un paid debts

From the facts given, the debt at issue, would be uncollectible based on the 4 year SOL period in California. However, these negative marks can and most likely will affect credit reports and the ability to obtain credit for major real or personal property purchases. Thus, legal settlement of these debts ASAP, for pennies on the dollar, may be VERY worthwhile and beneficial from that standpoint.
