Legal Question in Credit and Debt Law in California

Pay Day Loans

I have defaulted on a Pay Day Loan. They are calling me telling me to retain an attorney. something about it being a felony to have money transferd into my account and not paying it back, accross state lines. I said i didnt have the balance today, she said have a good day, and retain an attorney or one will be appointed to me. She is acting like they are going to arrest me at my place of work, is that possible?

Re: Pay Day Loans

Ms. Kleinpeter gives you good advice. They are trying to bully you into paying this. You may want to go to the NACA website, www.naca.net, and find a consumer attorney who can help you. Their tactics sound like violations of state and federal law and you need to be prepared.

Re: Pay Day Loans

Not only is it not a felony to owe money, it is illegal for the person trying to collect the money to imply you will be arrested.

Make sure to get all the information from anyone who calls you regarding this debt, save any paperwork they send you in the mail, and keep track of the phone calls.
