PayCheck Protection Overpaymet - Collections

I was in a bad car accident back in 1997 when I was a correctional officer with the state of california.

I had paycheck protection insurance thru the CCPOA benefit trust fund that I used while off work to recover.

They sent me a letter stating an overpayment was discovered in July of 1999. I had receive Catastrophic time bank hours after returning to work from fellow CO's that personnel had back dated and paid me for. I requested a breakdown of the overpayment from them in August of 1999 and never received it. They have sent me a letter post dated March 16 2005 with the breakdown demanding payment or it will be sent to a collection agency named American Asset Recovery Inc.

According to there records last overpayment was January 1998 and they discovered the overpayment in July of 1999. What is the statue of limitations on this issue and is it from date of overpayment or date of the discovery of overpayment.

The statute of limitations is up. Hire an attorney to send them a letter on attorney letterhead (this should not cost you more than $50 or so) to that effect.
