Legal Question in Credit and Debt Law in California

Ex not paying back

My girlfriend and her parents are owed about $1800 from her ex-boyfriend. Her parents wrote him a check with ''car loan'' written on it, and my girlfriend has a verbal agreement with him on the money loaned him. She has tried numerous times to get the money from him, but he does not pay. What can be done to have him pay them back?

Re: Ex not paying back

from the facts given, the check stipulated as a "car loan" should serve as sufficient written memorandum of the existence of a contract. if so, the court could fashion breach of contract remedies for the injured parties at issue here. thus, the best approach here would be to have a legal demand letter drafted and sent out on your behalf to the breaching party for the $1800. if this does not achieve your desired outcome, them simply proceed in taking this person to small claims court under a breach of contract action.
