Can i get out of paying a promissary note? when my mother past away, she and i shared a home, and my brother wanted money from that property, so i got a loan and paid him 40,ooo. the other 2 siblings declined, i made a note for 10,000.00 while i was nt in the best state of mind. my house is not worth 50,000.00 split 4 ways, im in credit card debt, i live alone and iam self employed. i think he is trying to sue me. please help.

It is difficult to understand what you are asking. It sounds as if you are trying to get out from a promissory note secured by real property. If so, it is unlikely you could "get out of paying" the note. You should consider speaking with an attorney as you are a likely candidate for bankruptcy. If you home is "under water", your home is probably safe.
