Payment for deposiation

I was told by a former client they would pay me $150 an hour for travel and deposition time, concerning a case they have with an ex employer of mine.

legal?

I am in KC the depo was in CA

The California Government Code provides for certain payment -- of a $35 witness fee and compensation for travel. If you're a witness for the former client, certainly, you can make an arrangement with that former client. Then, again, the opposing party can ask you about your arrangement, and you would have to answer truthfully. The payment could then affect your credibility when asked: "How much did X pay you for your testimony?" Of course, the correct answer is, "I was compensated for my time and travel, just like you and defendant's other attorneys are compensated for their time and travel."
