Legal Question in Credit and Debt Law in California

Payment in full on a check

I paid my credit card with a check and wrote on the bottom of the check PAID IN FULL. The payment was received late ( due to the mail) , So I recieved a statement with a late fee and

interest. I was under the assumption that if a company cashed a check that said payment in full

that they agree it is paid in full. Is this correct or not ? Thank you.

Re: Payment in full on a check

That impression is incorrect. If you have a ligitimate complaint or dispute with a company, and you clearly (perhaps in a cover letter) explain your dispute, and tell them why you are paying a reduced amount. Then, if they cash the check, you might have an argument.

With todays method of processing the thousands of checks that come through, it is unreasonable to expect a credit card company to inspect every check for "payment in full" notations.
