payment for an invoice that was signed for by an unauthorized user

About a year ago there was a man who leased one of my company trucks from me for his own business use. He then went to a tire shop that I had an account at and charged a full set of tires to my account. I have now been sent a notice to appear in small claims court by the tire company. Thwy want me to pay the $1500 that I never authorized. I have a copy of the invoice showing the guys signature. I never signed anything with the tire company stating that it was ok for other people to charge items to my account...especially not in that amount. Can I legally be held liable for the unpaid balance?

The answer is probably yes. However, you also have a cause of action against the person who purchased the tires and should pursue him for reimbursement of any amounts you are found to owe. You may also want to contact the District Attorney since this person's use of your credit card may constitute a crime such as theft, theft by deceit, or fraud.
