Legal Question in Credit and Debt Law in California

Tried to Pay-Then I received a Summons

Dear Attorneys,

Two years ago my husband lost his job and I could not make my credit card payments. A month ago after refinancing our house I attempted to pay off, by way of a settlement, the credit card debt. First I called the company itself who after four different calls lead me to thier legal dept. I called the Legal Dept. After several minutes I was told they could not find my information at all. They asked me to call back with the actual Credit card account number. I did. They still could not find anything refering to me. I asked them to send me a letter stating that. They said they would. They asked me to fax a copy of the billing statement so the Dept. head could sign off on it. I did. I then put the money into developing my business. Two days ago I got a Summons in an attempt to sue me for the total amount. Can I protect myself somehow? How? Thank you for your time.

You'll have to answer the lawsuit (quickly), but an attorney may also be able to work out a settlement with them before the lawsuit proceeds further.

We can help you defend this case. In addition, you may have a claim against the collection agency under the Fair Debt Collection Act. We would need to review your documents and lawsuit. Please fax all letters and the lawsuit to our office at 714 363 0229. I will call you so please provide your phone number.
